Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Credail mobile application and associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes through the app or our website.

2. Eligibility

  • You must be at least 13 years of age to use Credail. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
  • You must have a valid phone number capable of receiving SMS messages for account verification.
  • You must not have been previously banned or removed from the Service.

3. Account Registration and Security

  • Your account is created using your phone number, verified via a one-time password (OTP) sent by SMS.
  • You are responsible for maintaining the security of your device and account. Do not share your authentication credentials.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately if you suspect unauthorized access to your account.
  • You may change your phone number through the in-app number change feature, subject to verification.

4. Use of the Service

4.1 Permitted Use

You may use the Service for lawful personal and non-commercial communication purposes. This includes sending and receiving messages, making voice and video calls, sharing media and locations, creating status updates, and using the Credail Score features.

4.2 Prohibited Conduct

You agree not to:

  • Send spam, unsolicited messages, or bulk automated communications.
  • Transmit content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to manipulate or artificially inflate your Credail Score or another user's score through fraudulent means.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service or its AI scoring algorithms.
  • Use the Service to harass, stalk, or threaten other users.
  • Upload viruses, malware, or any other harmful code.
  • Collect or harvest other users' personal information without their consent.
  • Use automated scripts, bots, or other tools to interact with the Service without our prior written consent.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.

5. Credail Score

  • The Credail Score is an AI-computed metric that reflects communication quality, reliability, character, and language respectfulness based on your interactions within the Service.
  • Your score is calculated from four factors: Communication Integrity, Reliability & Responsibility, Character & Humility, and Speech Purity & Respectfulness. You can customize the weight of each factor.
  • The Credail Score is provided as an informational tool. While we strive for accuracy, the score is generated by AI and may not perfectly reflect every nuance of human communication.
  • No guarantees. We do not guarantee that the Credail Score is error-free or that it will accurately predict any individual's trustworthiness in all circumstances.
  • You acknowledge that your messages and call interactions are analyzed by AI systems to generate your score. By using the Service, you consent to this analysis.
  • Peer reliability ratings submitted by other users contribute to your score. These ratings reflect individual opinions and may be subjective.
  • Attempting to manipulate your Credail Score through artificial means (creating fake conversations, automated messaging, etc.) is a violation of these Terms and may result in account suspension.

6. Voice and Video Call Analysis

By making voice or video calls through Credail, you acknowledge and consent to the following:

  • Call audio and video may be processed by AI in real time to analyze tone, clarity, respectfulness, and consistency for Credail Score calculation.
  • Call metadata (duration, participants, timestamps) is recorded.
  • Group calls may use a Selective Forwarding Unit (SFU) server for media routing.
  • You are responsible for informing other call participants that the call may be analyzed where required by your local laws.

7. Chat Backup and Restore

  • Credail provides an optional feature to back up your chat history to your personal Google Drive account.
  • Backups are stored in a private, app-specific folder on your Google Drive that only Credail can access. The backup contains text message data (no media files).
  • You can restore backups when reinstalling the app or setting up a new device. Conflict resolution options (merge, replace, skip) are available for existing chats.
  • You are responsible for managing your Google Drive storage. We are not liable for data loss due to Google Drive issues, insufficient storage, or revoked permissions.
  • You can delete your backups at any time from within the app or directly from your Google Account settings.

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of the content you create and share through the Service (messages, photos, videos, status updates, etc.). By sharing content through the Service, you grant Credail a non-exclusive, worldwide, royalty-free license to transmit, store, and display your content as necessary to provide the Service (e.g., delivering messages to recipients, displaying status updates to your contacts).

8.2 Our Intellectual Property

The Service, including its design, features, code, AI algorithms, the Credail Score system, and all related trademarks and branding, are the property of Credail and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Account Termination

  • By you: You may delete your account at any time through the app settings. Account deletion enters a 30-day grace period during which you can cancel. After 30 days, all your data is permanently deleted from our servers.
  • By us: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. We will make reasonable efforts to notify you before termination unless doing so would compromise safety or legal compliance.
  • Upon account deletion, your messages in other users' chats will remain visible to them, but your profile information will no longer be accessible.
  • Google Drive backups created by you will remain in your Google Drive and must be deleted separately if desired.

11. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or secure at all times.
  • The Credail Score is an AI-generated metric and should not be the sole basis for any decision about an individual. It is not a credit score, background check, or character reference.
  • We are not responsible for the content of messages sent by users through the Service.
  • Third-party services integrated with Credail (Google Drive, Firebase, Twilio, etc.) are subject to their own terms and policies. We are not responsible for their availability or performance.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Credail and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, loss of profits, or loss of goodwill, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to these Terms or the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Credail and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Service, or your content.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction, as permitted by applicable law.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Credail regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
